Worker's Comp

Since 1995, our team has successfully taken dozens of cases to trial before Department of Labor judges. Our victories extend all the way to the South Dakota Supreme Court, where we have set important precedents for injured workers throughout the State. We have a good reputation with judges and other lawyers, which helps our clients get the best possible outcome. For the past 25 years, we have helped thousands of South Dakotans navigate this complex area of the law.

Long Term Disability (LTD) Claims

For years, we’ve helped South Dakota residents who have been denied long-term disability benefits by major insurers such as UNUM, Lincoln, MetLife, and Hartford. In these claims, we often need to contact medical or psychological professionals to better explain your disability. We know how the process works and can help you get the benefits you're entitled to.

Personal Injury Claims

For the past 25 years, we have helped those injured in car, motorcycle and truck collisions to receive fair compensation for their injuries. We thoroughly investigate each case, working with your medical providers to fully understand the extent of your injuries. We then present your case in the best possible light to the insurance company or even a jury if necessary. We have the experience and track record to handle complicated and significant injury claims from start to finish.

Bad Faith Claims

Workers’ compensation insurance companies have a duty to adjust your claim in “good faith”.  This means they can only deny claims when they have a reasonable basis.  When insurance companies violate their duty, they can be sued for the damages they cause, plus punitive damages to deter them from doing it to other people. This is called a “bad faith” lawsuit. We help our clients not only get fair compensation for their workers’ compensation claims, but also sue insurance companies in these lawsuits. We have helped set several important legal precedents, including a South Dakota Supreme Court case establishing that insurance companies can be sued for their use of biased “Independent Medical Examiners” to deny legitimate claims.
